TERMS AND CONDITIONS
1. GENERAL PROVISIONS
1.1. The online shop accessible at www.mundurki.drabczynska.pl hereinafter referred to as the “Online Shop” or “Shop”, is run by ANNA DRABCZYŃSKA, conducting her business activity under the business name of STUDIO MODY ANNA DRABCZYŃSKA, hereinafter referred to as the “Seller” (business address: ul. Zaułek 3, 43-300 Bielsko-Biała); NIP (Tax ID No.): 547-005-37-69, REGON (National Business Registry No.): 070439773.
1.2. The Online Shop sells goods via its website at www.mundurki.drabczynska.pl
2. TERMS OF USE AND CONCLUSION OF THE SALES CONTRACT
2.1. An order is placed by the Buyer in electronic form by filling out the order form available at www.mundurki.drabczynska.pl
2.2. The order is considered as received upon confirmation from the Seller. The order is considered as confirmed as soon as payment is received and posted to the Seller’s bank account. The Customer receives a confirmation of the order in a confirmation e-mail.
2.3. The shipping time is calculated in working days, starting from the day on which payment is posted to the Shop’s bank account (or settlement account in the case of credit card and electronic payments).
2.4. Information provided by the Buyer in the course of placing the order should be true, up to date, and accurate.
3. THE RIGHT TO WITHDRAW FROM THE SALES CONTRACT
3.1. The Buyer – Consumer who concluded a sales contract with the Online Shop may withdraw from it without providing any reasons by submitting a relevant statement in writing within 14 days of the day of receiving the product(s) purchased, excluding custom-made or personalised items (items made to measure). The statement should be sent to the following address: ul. Zaułek 3, 43-300 Bielsko-Biała or to the Shop’s e-mail address: mundurki@drabczynska.pl
3.2. The withdrawal statement must include in particular the order number, order date, the date on which the shipment was received, and information on the form of refund. The withdrawal form is available as an Appendix to these T&C..
4. METHODS OF PAYMENT, PRICES
4.1. The prices of the products available in the Online Shop are provided in PLN or EUR and include VAT. The prices do not include import duties and taxes which may apply in the case of shipping to addresses outside Poland.
4.2. The Buyer may choose the following payment methods:
a) bank transfer (bank account details are provided on the Shop’s website in the Payment and Delivery section);
b) TPAY.COM
4.3. The delivery time is calculated starting from the day on which payment is posted to the Shop’s bank account or settlement account, including the price for the goods purchased and the shipping costs. The order fulfillment time is up to 20 business days.
4.4. We wait for the payment to be processed for 5 working days. If we do not receive the payment by that time, the order is cancelled.
5. TERMS OF DELIVERY
5.1. The ordered goods are delivered to the Buyer via a courier service.
5.2. The Buyer should pay proper attention to the state of the package upon its receipt, in particular to whether the package is not damaged or destroyed.
5.4. Current shipping costs are provided on the Shop’s website at www.mundurki.
6. COMPLAINT PROCEDURE
6.1. Before sending back the product(s), the Buyer should contact the Online Shop in order to arrange the shipping date.
6.2. The defective product should be sent to the following address: Studio Mody Anna Drabczyńska, ul. Zaułek 3, 43-300 Bielsko-Biała
6.4. The original receipt/invoice should be attached to the product, along with a description of the defects and situations in which the given defect occurs; the description should be as precise as possible.
6.6. The Online Shop will inform the Buyer whether the complaint was accepted or rejected within 14 days of receiving the return package.
6.7. The product is sent back to the Buyer within 7 days from the day of processing the complaint. If the complaint is accepted, the shipping cost shall be covered by the Online Shop.
7. THE RIGHT TO EXCHANGE ITEMS
7.1. All of the goods available in the Online Shop are new and genuine, with some of them unique and one of a kind. Custom-made or personalised items (items made to measure) cannot be exchanged or returned.
7.2. The Customer may exchange a product purchased in the Online Shop for another product available in the Shop within 10 days of receiving the product without providing any reasons. In order to meet this deadline, the Buyer must send the relevant statement within the said period. The statement should be sent to the following address: ul. 7.3. A product may be exchanged for another product with features specified by the Buyer provided that such product is available in the Online Shop. If there is a price difference between the exchanged product and the new product, either the Buyer will pay the difference or the Seller will return it. The product exchanged in this manner should be returned in unchanged condition, unless the change was impossible to avoid in the course of normal use. The product should be sent to the following address: ul. Zaułek 3, 43-300 Bielsko-Biała.
7.5. The Seller undertakes to exchange the product immediately, no later than within 14 days of receiving the exchanged product.
8. ELECTRONIC SERVICES IN THE ONLINE SHOP
8.1. The Seller provides the following services to the Customers by electronic means:
a) the possibility to conclude sales contracts online in the Shop, in compliance with these Terms and Conditions;
b) the possibility to create an account in the Shop;
c) sending the requested information about the products.
8.2. The technical requirements necessary in order to use the services of the Online Shop are as follows:
a) access to the Internet;
b) web browser, e.g. Internet Explorer, FireFox, Google Chrome, Safari;
c) e-mail account.
8.3. The Customer is required to use the Online Shop in a manner compliant with the law and good practice, with respect for third-party personal and intellectual property rights. In particular, it is prohibited to:
a) send, post, e-mail or otherwise send or share content which is illegal, offensive, aggressive, unlawful, defamatory, obscene, libellous, which infringes privacy or incites hatred based on racial, ethnic or other differences;
b) send, post, e-mail or otherwise send or share content which may violate the law or the rights of other persons (including intellectual property and data protection rights);
c) send, post, e-mail or otherwise send or share any software, files or codes which may disrupt the operation of the Shop or cause computer software, hardware, networks or ICT devices to be destroyed;
d) violate the local, national, and international law in any way.
9. PERSONAL DATA PROTECTION
9.1. Upon placing an order, the Buyer – a natural person agrees to the processing of his/her personal data by the Online Shop, in compliance with the applicable provisions of the law, in particular with the Personal Data Protection Act and the Act on the Provision of Services by Electronic Means.
9.2. The personal data provided is processed by the Online Shop solely for the purpose of proper performance of the sales contract.
10. FINAL PROVISIONS
10.1. The Terms and Conditions become effective as of 1 December 2018,
10.2 For matters not settled herein, the applicable provisions of the Civil Code and other legal acts applicable to the activity and operation of the Shop shall apply.
10.5. The Shop and in particular its name, concept, graphic design, database, and trademarks constitute the property of STUDIO MODY ANNA DRABCZYŃSKA or the entities with which relevant agreements have been concluded and are subject to legal protection.
10.6 The latest version of the Terms and Conditions is always accessible to the Customer in the Help/Terms and Conditions section on the website at www.mundurki.
10.7. The Terms and Conditions shall be governed by the Polish law.
